Describe your educational background (including degrees, certifications and life experiences):
I was born in Orofino and raised in the Clearwater County logging town of Headquarters. I worked in the woods every summer while going to college. I received my BA from the University of Idaho and got my JD from the University of Michigan. I served three years in the US Army and was stationed with the Eighth Army in Korea. I practiced law in Seattle for ten years and in Anchorage for fifteen years. I received the highest rating that the lawyer rating firm of Martindale Hubbell gives in both of those cities. I also was a lawyer delegate to the Ninth Circuit Judicial Conference from both of those jurisdictions. I have represented the powerful, the Alaska off-shore oil industry, and vulnerable, a Caldwell homeless shelter. I represented the Anchorage bankruptcy court women clerks in a sexual harassment complaint against the bankruptcy judge that resulted in a reprimand and non-rreappointment.
Describe your community involvement (including civic groups, appointed/elected positions and dates):
I returned to Idaho in 1989. I received a Cernegie Hero Foundation award for rescuing an elderly friend from the Clearwater River in 1960.
I operate as a volunteer two drug courts and two mental health courts, one of each in Clearwater and Idaho Counties. I fought for over three years to establish the first mental health court in rural Idaho and it has become a model for rural outreach for the treatment of mental illness. I also have been active in recording oral histories about the early logging days in Clearwater County for the Clearwater County Historical Museum at Orofino and for the J Howard Bradbury Memorial Logging Museum at Pierce. I have spoken at many forums about the treatment of the mentally ill in rural settings and about providing judicial services in rural counties.
I served on the board of the Idaho County Soil and Water Conservation District.
Describe your employment history for the past 10 years including dates:
I then moved to Lewiston where I have taught international business and money and banking at Lewis-Clark State College during the past nine years. I also practised law part time and I was elected a district judge for Clearwater, Idaho and Lewis Counties in 2002. Before I was elected the judge was in Clearwater County two days a month and in Lewis Countiy once every other month. The rest of the time everybody had to go to Grangeville. There were 15 trials during the five years before I was elected. I am in Clearwater County two days a week, and in Lewis County one day and in Idaho County one day a week. I have had 53 trials in the five years since I was elected. I was awarded the Judicial Excellence Award by the Idaho Criiminal Defense Lawyers Association in 2006.
What are your three priority issues and why:
Make the court system more affordable:
Start night courts so Idaho wage earners don't have to choose between and day's pay and their day in court.
Install televideos so witnesses can testitfy in court form where they live to avoid the costs of transporting them to the trial.
Phase in electronic filing and records so files can be accessed by computer from anywhere in the country.
Make the court system more fair:
Fashion sentencing guidelines to promote a parity of sentences throughout the state
Have trained professionals to investigate and recommend resolutions for domestic disputes to reduce the acrimony caused by the adversary legal system
Institute mediation at the start of a lawsuit to see if the costs of litigation can be avoided before egos kick in and common sense takes its leave.
Make the court system more accountable
Stop judges from retiring early for the purpose of permitting their successors to be appointed so they won't have to stand for election
Remove the secrecy of judicial disciplinary records and proceedings so the complaints agaist judges will be subject to public and press scrutiny

What are your three priority issues and why:
Unlike partisan races, a judicial election is governed by strict ethical rules. Judges are prohibited from discussing the issues that are likely to come before them for resolution. For that reason, voters should consider the candidates’ judicial philosophies, abilities and experience.
As a Justice of the Idaho Supreme Court, I recognize that my first obligation is to uphold the Idaho Constitution, the United States Constitution and the laws of this state. In doing so, I recognize the importance of judicial restraint. Judges are to respect the role of the Legislature in determining public policy. The role of judges is to fairly interpret the law, not to impose their views of what the law ought to be under the guise of constitutional or statutory interpretation.
My service as a Justice of the Supreme Court is an extension of a career dedicated to serving the people of this State. I am a Supreme Court Justice because of merit; not based upon my skills as a politician. I was one of twelve attorneys and judges who applied to fill the vacancy created by the resignation of Justice Linda Trout. The Idaho Judicial Council – a non-partisan group composed of citizens, lawyers and judges – reviewed our qualifications and conducted public interviews before submitting four names to the governor. Governor Otter explained that he appointed me because of my “insightful legal scholarship, keen intelligence, integrity and independence.”
